Please read these Terms of Service carefully before using the D'Bay platform. By accessing or using our services, you agree to be bound by these terms. If you do not agree, please do not use our platform.
1 About D'Bay
Doctors Bay (trading as D'Bay, accessible at dbay.co.in) is a healthcare technology platform owned and operated by SOMI Technologies, a company incorporated under the Companies Act, 2013, registered in India.
D'Bay connects patients with verified, licensed medical professionals and registered pharmacies. We are a technology intermediary — we do not provide medical advice, diagnosis, or treatment. All medical decisions remain solely with the registered medical professionals on our platform.

2 Eligibility
By using D'Bay, you confirm that:
- You are at least 18 years of age, or accessing the platform under the supervision of a parent or legal guardian.
- You are legally capable of entering into a binding agreement under the Indian Contract Act, 1872.
- Doctors and pharmacies must hold valid, current registrations with the appropriate regulatory authority (NMC, State Medical Council, or equivalent).
- You will provide accurate, current, and complete information during registration.
3 Services Provided
D'Bay provides the following technology services:
- Patient Portal: Search and book appointments with registered doctors near you.
- Doctor Console: Digital consultation management, prescription generation, and patient records.
- Pharmacy Network: Receive digital prescriptions via WhatsApp and fulfill them for patients.
- SmartDose: Medication adherence reminders for patients.
- Payment Processing: Secure collection of platform fees and appointment booking fees.
D'Bay reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice.
4 Doctor & Pharmacy Registration
Doctors and pharmacies registering on D'Bay agree to:
- Pay a one-time registration fee of ₹1,000 and a monthly subscription of ₹1,000 to maintain an active listing.
- Provide authentic registration certificates, qualifications, and identification documents.
- Maintain valid registration with the appropriate medical/pharmacy regulatory authority throughout the subscription period.
- Not misrepresent qualifications, specialisations, or experience.
- Comply with all applicable laws including the National Medical Commission Act 2019, Drugs and Cosmetics Act 1940, and the Telemedicine Practice Guidelines 2020.
D'Bay reserves the right to suspend or terminate any doctor or pharmacy account found to be in violation of these terms, without refund of fees paid.
5 Payments & Refunds
Enrollment Fees:
- The ₹1,000 one-time registration fee is non-refundable once account activation is confirmed.
- Monthly subscription fees are non-refundable for the current billing cycle.
- Cancellation of subscription will take effect at the end of the current billing period.
Appointment Booking Fee (₹100):
- A ₹100 platform convenience fee is charged per appointment booking. This fee is collected by D'Bay and is separate from any consultation fee charged by the doctor.
- The ₹100 booking fee is non-refundable under all circumstances, including patient cancellations and patient no-shows.
- In the event a doctor cancels or is unavailable, the patient will receive a D'Bay Credit of ₹100, valid for 90 days, which can be applied toward any future appointment booking on the platform. No cash or UPI reversal will be issued.
- D'Bay Credits are non-transferable and hold no cash value outside the platform.
The ₹50 slot reservation fee is a non-refundable platform convenience charge. It is payable to confirm an appointment slot and is not a payment for medical services. D'Bay does not process refunds for any booking fees under any circumstances. Patients are advised to ensure availability before booking.
All payments are processed securely. D'Bay does not store your full card or UPI details.
6 User Responsibilities
All users of D'Bay agree to:
- Not use the platform for any unlawful, fraudulent, or harmful purpose.
- Not attempt to reverse-engineer, scrape, or reproduce any part of the platform.
- Not impersonate any doctor, pharmacist, or other individual.
- Not submit false medical information, fake prescriptions, or fraudulent payment details.
- Maintain the confidentiality of their account credentials.
- Immediately notify D'Bay of any unauthorised use of their account.
7 Intellectual Property
All content, design, code, logos, brand names, and features on D'Bay — including but not limited to "D'Bay", "Doctors Bay", "SmartDose", and all associated visual identity — are the exclusive intellectual property of SOMI Technologies
- All rights are reserved under the Copyright Act, 1957 (India).
- Trademarks are registered/pending registration under the Trade Marks Act, 1999 (India).
- No part of this platform may be copied, reproduced, modified, distributed, or used commercially without express written permission.
- Any unauthorised use constitutes infringement and will be pursued under applicable Indian and international law.
⚠️ Copying, cloning, or imitating the D'Bay platform, brand, or concept for commercial purposes is strictly prohibited and will result in legal action under the Copyright Act, 1957 and the Trade Marks Act, 1999.
8 Medical Disclaimer
D'Bay is a technology platform only. We do not:
- Provide medical advice, diagnosis, or treatment recommendations.
- Verify the accuracy of prescriptions or medical advice given by doctors on the platform.
- Take responsibility for the quality or outcome of medical consultations.
The doctor-patient relationship is solely between the patient and the registered medical professional. D'Bay shall not be held liable for any medical outcome, adverse reaction, or loss arising from consultations or prescriptions facilitated through the platform.
9 Limitation of Liability
To the maximum extent permitted by applicable law:
- D'Bay's total liability for any claim shall not exceed the amount paid by you to D'Bay in the 3 months preceding the claim.
- D'Bay shall not be liable for any indirect, incidental, special, or consequential damages.
- D'Bay shall not be liable for service interruptions caused by third-party providers (Firebase, WhatsApp, payment gateways, internet providers).
10 Termination
D'Bay may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:
- Breach of these Terms of Service.
- Fraudulent activity or misrepresentation.
- Non-payment of subscription fees.
- Regulatory non-compliance.
Upon termination, your right to use the platform ceases immediately. Data deletion will follow our Privacy Policy guidelines.
11 Governing Law & Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of India.
- Any disputes arising from these terms shall first be attempted to be resolved through mutual negotiation within 30 days.
- If unresolved, disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996.
- The courts of Bengaluru, Karnataka, India shall have exclusive jurisdiction over any matters not resolved through arbitration.
12 Changes to These Terms
D'Bay reserves the right to update these Terms of Service at any time. Changes will be notified via:
- A notice on the D'Bay website.
- WhatsApp or email notification to registered users (where applicable).
Continued use of the platform after changes constitutes acceptance of the revised terms.
